NRI to be paid Rs. 1 lakh as damages by British Airways, American Airlines

New Delhi, December 23: A United States-based non-resident India will be paid Rs 1 lakh as damages by the British Airways and the American Airlines. The order has been given to the airlines by a district consumer forum for an inordinate delay in delivering the NRI’s luggage during his trip to hometown Calicut in Kerala in 2006.

The district consumer forum headed by its President C K Chaturvedi and comprising members Neeru Mittal and S R Chaudhary ordered the two airlines to pay the damages to Dr. Manoj Kumar as he was delivered his luggage when he was to return to New York after his 12-day trip to Calicut. “We assess harassment and damages for Rs 1 lakh and this amount will be paid in the ratio of 30:70 between the American Airlines and British Airways,” said the forum, asking the two airlines to share the damages.
The order came on a complaint by Dr Kumar, a New York resident, who had booked his air tickets from New York to New Delhi for August 18, 2006 and a return ticket for August 30, 2006.
For travelling from New York to London, Kumar had booked his ticket with American Airlines and then with Indian Airlines for his onward journey from London to New Delhi, while checking in his baggage directly from New York to New Delhi through American Airlines. Since his connecting flight of American Airlines from New York to London was delayed, he travelled by British Airways. Upon arrival at New Delhi, he could not find his luggage and was assured by the British Airways that his baggage will be delivered to him at Calicut.
