New Delhi, January 25,2012: A non-resident Indian man working in a hotel in Oman has been ordered by a Delhi court to pay a monthly alimony of Rs 15000 to his estranged wife living here. Metropolitan Magistrate Vandana Jain asked Afsar Raza Rizvi, working in Alraha Hotel in Oman, to give maintenance to his wife, saying he has no liability other than maintaining his spouse. “It is to be noted that she (wife) is the only person whom respondent (husband) is liable to maintain as he has nowhere, in his reply, rebutted this fact. In the backdrop of the facts, it is difficult to assess how much actually the man would be earning.
“Since adverse inference has already been drawn against him, I award interim maintenance of Rs 15,000 per month to the aggrieved person i.e. the woman,” the court said. The magistrate refuted Rizvi’s claim that his income was meagre, saying bank documents submitted by him were not “trustworthy” as he has tried to beguile “the court by not giving the details of his salary account”. “Despite several directions, he has not filed his pay slip on record and rather has filed one certificate alleged to have been issued by the managing director of the hotel which also does not appear to be genuine as it is also not supported by the pay slip of the man. Hence, documents filed by him are not trustworthy and cannot be relied upon,” the court said. The court’s order came on a complaint by the woman who said she was Rizvi’s legally wedded wife but due to some disputes they have started residing separately.
